Types of DUI Cases
There are several types of DUI cases ranging from misdemeanor
charges to felony charges.
If your driver's license was restricted in any way,
you have a prior DUI conviction, or you had a child
in the vehicle when you were stopped for DUI, you may
be facing a felony DUI.
The Bermudez Law Office provides excellent, experienced,
and committed Phoenix DUI attorneys. We are committed

Any DUI charge is very serious; whether it’s your
first or subsequent DUI, you may be facing very serious
penalties. A first offense DUI will involve jail, fines,
a certified ignition interlock device on any vehicle
you operate, a license suspension and education and
treatment. An experienced Phoenix DUI attorney can help
you understand your rights.
DUI and Mandatory License Suspension
If you’ve been charged with a DUI and blood or
breath alcohol concentration exceeds the statutory limit
you will likely also receive an Admin Per Se or Implied
Consent Affidavit. This is notice that the Motor Vehicle
Division will suspend your Arizona driver’s license
or the privilege to drive in Arizona if you do not have
an Arizona driver’s license. This document will
inform you that the suspension will go into effect unless
you request a hearing. You can request an MVD hearing
or contact a DUI attorney to assist you in protecting
your ability to drive in Arizona.
Aggravated DUI
Aggravated DUI is a felony and the most serious DUI
charge. You may be facing an Aggravated DUI if you are
charged with DUI and there was a restriction on your
driver’s license, if the current charge is your
third DUI within 7 years, or, if you have a child under
15 years of age in the vehicle when you were stopped
for DUI.
Aggravated DUI can carry a prison sentence. Call Bermudez
Law to schedule a free consultation with a Phoenix DUI
Attorney.
