MISDEMEANOR DUI LAWS
First Offense Regular DUI: $250 + 80% surcharge, $1000 Prison Fund, $1000 DPS fund, Mandatory 12 months Certified Ignition Interlock Device requirement, 1 day to 6 months jail, Education and Treatment, Possible Community Restitution, and License Suspension

Second Offense Regular DUI (within 7 years of First Offense): $500 + 80% surcharge, $1500 Prison Fund, $1500 DPS Fund, Mandatory 12 months Certified Ignition Interlock Device requirement, 30 days to 6 months jail, Education and Treatment, Minimum 30 hours Community Restitution, 1 year License revocation.

First Offense Extreme DUI with BAC from .15 to .19: $500 + 80% surcharge, $1250 Prison Fund, $1250 DPS Fund, $250 Abatement Fee, Mandatory 12 months Certified Ignition Interlock Device, at least 30 days Continuous Alcohol Monitoring, 10 days to 6 months in jail, Education and Treatment, Possible Community Restitution, License Suspension

Second Offense Extreme DUI with BAC from .15 to .19: $500 + surcharge, $1250 Prison Fund, $1250 DPS Fund, $250 Abatement Fee, Mandatory 18 months Certified Ignition Interlock Device, 30 or more days Continuous Alcohol Monitoring, at least 60 days jail, Education and Treatment, Minimum 30 hours Community Restitution, 1 year License Revocation

First Offense Extreme DUI with BAC .2 or higher: $500 + surcharge, $1000 Prison Fund, $1000 DPS Fund, $250 Abatement Fee, Mandatory 18 months Certified Ignition Interlock Device, 30 or more days Continuous Alcohol Monitoring, at least 45 consecutive days jail, Education and Treatment, Possible Community Restitution, License Suspension

Second Offense Extreme DUI with BAC .2 or high: $1000 + surcharge, $1250 Prison Fund, $1250 DPS Fund, $250 Abatement Fee, Mandatory 24 months Certified Ignition Interlock Device, 90 or more days Continuous Alcohol Monitoring, at least 90 consecutive days jail, Education and Treatment, Minimum 30 hours Community Restitution, 1 year License Revocation

Types of DUI Cases

DUI and Mandatory License Suspension
If you’ve been charged with a DUI and blood or breath alcohol concentration exceeds the statutory limit you will likely also receive an Admin Per Se or Implied Consent Affidavit. This is notice that the Motor Vehicle Division will suspend your Arizona driver’s license or the privilege to drive in Arizona if you do not have an Arizona driver’s license. Aggravated DUI
